'The Convergence of Contract and Tort Law in Medical Liability Law. A Dogmatic Analysis of the Principles Governing Medical Liability Law': In medical liability law, a parallelism of contractual and tortious claims is presumed. However, the consideration of structural peculiarities in contracts and torts shows that a blanket identical standard of liability is not justifiable. This work deals fundamentally with the structure of duties in contract and tort law as well as the evidentiary implications of a dogmatically imprecise justification of liability. It proposes a solution that is structurally inherent in the BGB.
